As an EU consumer purchasing services online (a "distance contract"), you generally have the right to withdraw from a contract within 14 calendar days without giving any reason. This is known as the "cooling-off period".
However, the right of withdrawal does not apply to our fitness classes for two distinct legal reasons explained below. We are required to inform you of these exemptions clearly before you complete a booking.
By completing a booking with Mom Fitness Club, you acknowledge that the right of withdrawal does not apply to your purchase, as our fitness classes fall within the exemptions provided by Article 16 of EU Directive 2011/83/EU.
This means that once your booking is confirmed and payment is received, you are not entitled to a 14-day cancellation right under EU consumer law. Our cancellation policy (no refunds after 18:00 the evening before the class) applies instead — see our Terms & Conditions.
EU Directive 2011/83/EU, Article 16(l) explicitly excludes the right of withdrawal for:
Our fitness classes are leisure and sport services scheduled on specific, fixed dates and times (e.g., every Monday at 10:30, Wednesday at 10:00, Thursday at 10:00). Each booking is for a defined date and session. This exemption applies directly and in full to all Mom Fitness Club classes.
Separately, Article 16(a) of the same Directive provides that the right of withdrawal is also lost for:
When you attend a class, the service is fully performed at that point. By completing the booking, you give your prior express consent to the service beginning (and being fully performed) before the 14-day cooling-off period expires, and you acknowledge this results in the loss of your right of withdrawal.
Both of these grounds independently apply to each booking. This dual basis ensures full legal clarity under EU consumer law, regardless of how the booking is interpreted.
